Blossom Social Care Training Terms and Conditions
Any training product or service offered by Blossom Social Care Training will be conducted, without exception, in accordance with these terms and conditions and any booking will be considered as an acceptance of these terms and conditions.
1. Definitions
The term Training Provider means Blossom Social Care Training, their agent or representative. Client means the organisation booking and/or paying for the services. Delegate means a person attending the training course.
2. Bookings
Bookings and any enquiries must be directed to Blossom Social Care Training, or their appointed agent or representative (the identity of which will be advised to the client). Bookings must be confirmed in writing by the client and will be considered as confirmed upon receipt of such notification. The training provider will accept provisional bookings but will incur no liability in respect of them. Either the training provider or the client may cancel such a booking until it is confirmed in writing.
3. Notification of Delegates
The number of delegates must be agreed at the time of the booking and confirmed in writing. This figure cannot be increased by the client without prior agreement of the training provider, but should not exceed 20. Only delegates from the commissioning organisation may attend the training and places on any course must not be given or sold to other any other organisation without the written agreement of the trainer.
4. Cancellations
All confirmed bookings that are cancelled by the client will carry a cancellation fee within the following timeframes:
Within 28 days of the course commencement = 50% of the full fee.
Within 14 days of the course commencement = 75% of the full fee.
Within 7 days of the course commencement = 100% of the full fee.
If the training provider is notified of a cancellation within the time frames indicated above, it will be at the discretion of the provider whether the training course can be rearranged. The provider will always endeavour to accommodate requests for an alternative date. The original booking will however remain subject to the standard cancellation costs itemised above.
5. Prices & Payment
Training costs are calculated taking various factors into account including: the length of course, the number of delegates and other factors such as location. Bespoke training packages will incur additional costs to reflect additional planning and preparation required. These prices will be notified at the time of booking. Should the number of delegates increase above the prior agreed number then this will incur an additional charge per delegate. Clients will be invoiced by the training provider by email and payment is required within 28 days of the invoice date. Late payment will incur an additional charge of 10%.
6. Travel costs, Accommodation & Subsistence
Mileage will be charged at the current HMRC rate. Where travel to the course venue exceeds one hour, travel time for the trainer will also be charged at £20 per hour. Where training is to be provided for a period of more than one working day then the client will be responsible for funding acceptable overnight accommodation. Where a training course is due to start or finish at such a time that it would be unreasonable for the trainer to travel to or from the training venue on the day, then acceptable accommodation must be funded by the client. This generally means hotel accommodation of 3* rating or higher. Unless agreed by the training provider, subsistence costs will also be funded by the client for the period of training provided.
7. Training venue
It will be the responsibility of the client to provide and fund a suitable venue of sufficient size to accommodate the number of agreed delegates. The client will also ensure the trainer has access to a projector and screen and to flipchart and paper at the venue for the duration of the training course.
8. Equipment & Belongings
The training provider will not accept liability for loss or damage to any equipment or other belongings, however caused. Delegates are responsible for the safekeeping and appropriate use of items loaned to them during the training course. Damage or loss of such items will be charged to the client.
9. Health & Safety
The training provider will take all reasonable steps in relation to the health and safety of the trainer and/or delegates; however, the ultimate responsibility for all health and safety issues remains with the client throughout.
10. Confidentiality
The client and delegates will keep secure and not disclose any information of a confidential nature obtained during the training except information that is already in the public domain. The provisions of this section shall apply during the life of this agreement and indefinitely thereafter.
11. Force Majeure
The provision of training may be totally or partially suspended or cancelled by the training provider to the extent that delivery is prevented through circumstances beyond its control. In such unlikely instances, the training provider will not be responsible for any costs incurred by the client due to late cancellation e.g. room booking. The provider will make every effort to offer alternative training dates within the next three months if appropriate.
12. Copyright
The training provider retains intellectual property rights in relation to all training materials and resources provided, none of which may be reproduced, modified, amended, stored or distributed, in any form or by any means, otherwise than for the purpose specified by the training provider. The material may not be used by the client, delegate or other party for training purposes.
13. Variation
No variation of these terms will be valid unless evidenced in writing and signed by a duly authorised representative of the training provider.
